Instructions for filing a claim with the City of Germantown:

Please read all instructions on this page before completing the claim form.  You must fully complete all applicable sections listed below along with the Accident Questionnaire and Claim Form or your claim will be deemed as incomplete.

^{Note: Under the Governmental Tort Liability Act (GTLA), the City has immunity for defects or hazards involving unsafe streets absent a proof of prior notice and reasonable amount of time to repair. This can be found under TCA 29-20-203. The burden is on the plaintiff to prove that the City had either actual or constructive notice of the hazard prior to the incident. In other words, someone had called and reported the hazard to the City and the City in turn failed to repair it within a reasonable amount of time. The City also has immunity under TCA 29-20-204 which addresses all public structures which covers everything else other than streets.}

• Provide the exact date and approximate time of the alleged incident.
• If applicable, provide the street address where the alleged damage/injury, if known.
• Provide the full name, mailing address, email address, and telephone number of the person(s) claiming the damage/injury.
• Describe the incident in full detail.
• Describe in full detail the facts surrounding the incident that support your claim.  State all facts that support your claim and why you believe the City of Germantown is responsible.
• State the total dollar amount being claimed as a result of the alleged damage/injury.  If damage/injury is continued or anticipated in the future, indicate with a "+" following the dollar amount.  Include paid receipts and cost estimates.
• The claim form must be signed by the claimant or authorized representative.  The City will not accept the claim without an original signature and date of signature.
